These General Terms and Conditions (GTC) apply to the use of the platform Weblisting.ch (hereinafter "Platform"). The operator is the person or entity named in the Legal Notice (Impressum) (hereinafter "Operator"). The Privacy Policy and Cookie Policy apply additionally.

1. Acceptance of Terms

By accessing or using the Platform, you agree to these GTC. If you do not agree to these terms, you may not use the Platform. The use of individual features (e.g., registration, booking, listing, generator) may require renewed consent.

2. Description of Services

Weblisting.ch is a multifunctional online portal. It includes in particular:

• Business directory and company listings
• Marketplace (classifieds)
• Auto marketplace
• Real estate listings
• Services, online bookings, and table reservations
• Job board
• Events
• Free quote requests
• Deals of the week and other promotional opportunities (boosts, banners)
• Vendor posts/news, editorial blog, and help center
• Free generators and calculators (tools)
• Partner program (affiliate program / referral system)
• Search, comparison, watchlists, and related features

The scope of features may vary depending on the plan, role (visitor, customer, vendor), and technical availability. The Operator may expand, restrict, or discontinue features to a reasonable extent.

3. Contractual Relationship and Intermediary Role

The Operator provides the technical infrastructure and facilitates contact between users. The Operator does not become a party to transactions initiated via the Platform unless expressly defined otherwise below (e.g., vendor subscription with the Operator).

Contracts for goods, vehicles, real estate, services, events, jobs, quotes, reservations, or other services are concluded exclusively and directly between the users (buyers, clients, applicants, guests) and the respective providers ("Vendors" / sellers / employers / advertisers).

The Operator checks listings randomly or as part of moderation, but provides no guarantee regarding accuracy, availability, quality, legality, or fulfillment.

4. Registration, Territory, Review, and Verification

You are responsible for keeping account credentials and passwords confidential. All activities under your account are attributed to you. You must provide truthful and up-to-date information.

Registration as a Vendor is restricted exclusively to companies and self-employed individuals with a registered office or place of business in Switzerland or Liechtenstein. The Operator may request verification (e.g., UID, commercial register, ID or address proof) and reject or suspend registrations from other countries.

New listings and major edits are subject to administrative review. Public visibility occurs generally after moderation. There is no entitlement to activation.

For pre-listed or claimable entries ("Claim"): Only the authorized owner may claim the listing. False claims may be rejected and the account suspended.

5. Specific Provisions for Modules

a) Services, Bookings, and Table Reservations: Vendors define availability, prices, service locations, and cancellation terms. Online bookings are binding upon confirmation. Table reservations are requests with the business; the contract is formed directly with the business.

b) Marketplace (Classifieds): Advertisers guarantee accuracy and authority to offer goods. Prohibited items listed under Section 6 apply. Contracts are strictly between seller and buyer.

c) Auto Marketplace: Advertisers guarantee key vehicle details (condition, mileage, year, flaws, price). The Operator assumes no warranty or liability for vehicles.

d) Real Estate: Listings must reflect real conditions. The Operator acts solely as an advertising host, not a broker.

e) Job Postings: Listings must represent real existing positions without misleading requirements. Applications go directly to the employer.

f) Events: Event details stem from the advertiser. Event contracts are formed directly with the organizer.

g) Free Quotes: Quote requests are non-binding unless explicitly stated. Contracts arise strictly between client and Vendor.

h) Deals of the Week, Boosts, and Ads: Boost fees are non-refundable after activation.

i) Listings, Posts, and Blog: Vendor posts belong to the provider. The Operator may remove content violating GTC or applicable law.

j) Generators and Tools: Generators produce orientation drafts only and do not constitute legal or tax advice. Inputs are processed locally in the browser.

6. Permitted Industries and Content Restrictions

Strictly prohibited content includes: adult/escort services, illegal goods/drugs/weapons, hate speech/infringing material, and spam/manipulation. The Operator reserves the right to ban accounts and report violations.

7. User Content, Reviews, and License

You retain rights to your content but grant the Operator a royalty-free license to host and display it on the Platform for publication purposes.

8. Rates, Subscriptions, Boosts, Partner Program, and Commissions

Vendor pricing is set out on the pricing page. Free plans remain permanently free (0 CHF). Paid subscriptions are billed in advance in Swiss Francs (CHF).

a) Booking Commission: The Operator may charge a platform commission on online bookings as outlined in the vendor portal.

b) Partner Program (Affiliate Program): Registered users and partners can generate individual referral links (?via=CODE) to recommend Weblisting.ch.

• Commission Eligibility: Entitlement arises exclusively when a referred new business arrives via the referral link within the 30-day cookie period and successfully pays for its first company package.
• First Purchase Only: Commission applies strictly to the first paid package. Renewals, follow-up invoices, boosts, and wallet top-ups are excluded. Refunds cancel the commission.
• No Self-Referral: Using your own referral link for your own company accounts is strictly prohibited. Violations lead to cancellation and account suspension.
• Payout: Payouts can be requested starting at a minimum approved balance of 50 CHF via manual bank transfer to a valid Swiss (or Liechtenstein) bank account (IBAN).

9. Payment Processing, Wallet, and Payouts

Online payments are processed via Stripe. Vendor payouts are subject to review and bank account verification.

10–16. Standard Provisions

Covers cancellations, intellectual property, platform availability, liability limits, data protection, account deletion, and amendments.

17. Governing Language

In the event of discrepancies between translated versions, the German version of these GTC shall be legally binding and controlling.

18. Applicable Law and Jurisdiction

Swiss law applies exclusively. Place of jurisdiction is Frauenfeld, Switzerland.
