The legal terms for using our platform.
1. Acceptance of Terms
By accessing or using the platform Weblisting.ch, you agree to be bound by these Terms and Conditions (T&C). If you do not agree to these terms, you may not use the platform.
2. Contractual Relationship and Intermediary Role
Weblisting.ch is a multifunctional online portal (business directory, marketplace, auto market, service & booking platform, and job board). The operator merely provides the technical infrastructure and acts as an intermediary.
Contracts regarding marketplace items, services, vehicles, job postings, or appointment bookings are concluded exclusively and directly between the users (buyers/clients/applicants) and the respective providers ("Vendors" / sellers / employers).
3. Registration, Approval, Territory, and Verification
You are responsible for keeping your account credentials and passwords confidential. All activities occurring under your account are attributed to you.
Registration as a Vendor (creating company listings, services, vehicle listings, or job offers) is strictly limited to companies and self-employed individuals based or operating in Switzerland or Liechtenstein. The operator may request appropriate proof and reject or suspend vendor accounts from other countries.
New listings and offers are subject to administrative review. Public visibility and activation occur only after approval by the operator.
4. Module-Specific Provisions
a) Services & Bookings: Vendors define availabilities, pricing, and service locations. Bookings are binding. For cancellations made by clients, the cancellation policies displayed during the booking process apply.
b) Auto Market & Marketplace (Classifieds): Advertisers guarantee the accuracy of all provided information (condition, mileage, year of manufacture, defects). The operator is neither buyer nor seller and provides no warranty or guarantee for listed vehicles or products.
c) Job Offers: Job postings must correspond to actual existing job openings and must not contain misleading or discriminatory requirements. The operator assumes no liability for the recruitment process.
5. Permitted Sectors and Content Restrictions
The platform serves the mediation of legal goods, jobs, and services. The following are strictly prohibited:
- Erotic Services: Escort services, prostitution, erotic massages, or sexually explicit service offers (the sale of legal adult goods/products via standard e-commerce online shops is permitted).
- Illegal Goods: Trade in weapons, narcotics, illegal substances, or prescription drugs.
- Unlawful Content: Racist, counterfeit, discriminatory, or defamatory listings.
6. Pricing, Subscriptions, Boost Packages, and Commissions
Vendors are subject to the rates specified for their chosen package. All prices are listed in Swiss Francs (CHF). Subscription fees are billed in advance. One-time fees for promotional and Boost Packages (e.g., Offers of the Week) are non-refundable once activated.
7. Payments, Wallet, and Payouts
Online payments are processed securely via Stripe. Additionally, internal wallet balances or offline payment methods offered by the vendor (cash/bank transfer) may be used. Payouts to the vendor's Swiss bank account must be requested via the Vendor Dashboard and will be executed following verification by the operator.
8. Account Deletion
Users and Vendors may request account deletion at any time via the internal Support Ticket System in their dashboard. Deletion will be completed within 30 days, provided no legal retention obligations (e.g., accounting records) apply.
9. Disclaimer of Liability
The platform is provided on an "as is" basis. The operator assumes no liability for the accuracy of listings, the quality of services, the condition of vehicles, or technical downtime.
10. Controlling Language
In the event of discrepancies or conflicts between translated versions (e.g., French, Italian, English), the German version of these T&C shall prevail.
11. Applicable Law and Jurisdiction
These terms are governed exclusively by Swiss law. Place of jurisdiction is Frauenfeld, Switzerland.
